Quick answers before you start

How do I choose a DIFC will type?

Start with the assets and family instructions the will needs to address. Compare the appropriate will type and its intended coverage with professional advice before preparing the registration records and signing arrangements.

What should I prepare beyond a completed DIFC draft?

Plan the required records and electronic registration steps for the testator and witnesses. Confirm the current portal and appointment instructions, and retain the final registration output rather than treating draft completion as registration.

A will-type brief

Identify assets and appointments to cover so available document types can be compared with professional advice.

An instructions and records pack

Organise family details and asset information, with digital-asset access arrangements considered separately from general records.

A registration handover

Coordinate agreed electronic registration steps and retain the final document, confirmations and future amendment considerations.

Firswood directly manages the preparation and registration workflow. The registry determines eligibility; legal advice and lawyer-prepared wills require an identified DIFC-registered Wills Draftsman.

Services / The essentials

Which DIFC will fits your estate?

The DIFC Courts Wills Service is a route for eligible non-Muslims to register estate instructions. Its Full Will and specific-purpose forms serve different needs, including property, financial assets, business interests, guardianship and digital assets. Start with what you own and whom you want to appoint. If you are still choosing a registry, first compare the considerations in our Dubai wills overview.

Firswood Consultancy, trading as CompanyFormation.ae, directly manages DIFC will preparation and registration coordination. We bring together your instructions, supporting records and appointment arrangements. Where a lawyer prepares the will, identify the responsible DIFC-registered Wills Draftsman and the advice included. Some will types use prescribed online templates; confirm the appropriate method and review responsibilities before registration.

Information to prepare for a DIFC will

Prepare the passport and Emirates ID where applicable. Check that names in the draft agree with identity and ownership records.
Record the intended executors and beneficiaries, and guardian information where relevant. Discuss substitutes and practical contact arrangements before the draft is approved.

Assets and registration

Compile property, company-share or financial-account information appropriate to the chosen will. Distinguish the legal owner and any jointly held interests.
Keep the final proposed document and existing wills available for review. Prepare the witness identification and other uploads requested by the registration portal.

DIFC will types, company shares and digital assets

Check the coverage and limits of the proposed document before preparing its registration file.

01

Full Will or a specific-purpose DIFC will?

List the property, accounts, company shares and family appointments you intend to cover. Then ask which will type accepts those instructions and what it leaves outside its scope. A Full Will and a Property, Financial Assets or Business Owners Will are different documents; choosing the shorter template does not establish that it is suitable. For the separate civil-court route, review Abu Dhabi will registration with your appointed professional. Source: DIFC Courts: Wills Service FAQs.

02

Company shares and business continuity

Prepare a shareholding record showing the company, jurisdiction, number or class of shares and registered owner. Keep shareholder agreements and transfer restrictions alongside it. A DIFC Business Owners Will is intended for eligible UAE company shares; it is not a general substitute for company governance. If you are also considering a RAK ICC foundation, have the interaction reviewed before transferring assets or changing estate instructions. Source: DIFC Courts: Business Owners Will.

03

Digital assets need specific preparation

Identify the digital assets you own, how they are held and who should receive them. The DIFC Digital Assets Will uses a dedicated electronic process, so supported assets and access arrangements need checking against the current service instructions. Keep a general asset inventory separate from private keys and recovery phrases; sensitive access information does not belong in an enquiry form or shared planning spreadsheet. The work, step by step

Preparing for DIFC electronic registration

Coordinate the information and appointment without blurring the registry’s role and the drafting professional’s responsibilities.

  1. 01

    Establish scope and eligibility

The DIFC Wills Service is a non-Muslim route. Confirm personal eligibility, the intended assets and appointments, and the appropriate will type with the registry before preparing the file.

  2. 02

    Confirm the responsible drafting professional

If a lawyer prepares the will, verify their entry on the DIFC Courts Register of Wills Draftsmen and identify their responsibilities in the engagement. The registry also describes self-drafting and prescribed-template routes; confirm which preparation method applies.

  3. 03

    Prepare and review the document

Complete the appropriate portal template or arrange the permitted draft. Check names, ownership information and instructions before approving it.

  4. 04

    Book and prepare the registration

Follow the portal’s payment and appointment process. Coordinate the required witnesses, identification and device access for electronic signing.

  5. 05

Complete signing and retain the record

Follow the registry’s instructions during the appointment. Preserve the registered electronic will and the information needed to retrieve or review it.

Complex instructions or missing ownership records may require further review before the draft is ready.

Looking ahead

Maintaining a DIFC will

The selected form should remain aligned with your circumstances and intended estate.

Preserve the electronic original

Retain the issued file and registry reference, and make suitable retrieval arrangements for the person who may later administer the estate.

Review assets and appointments

A new company interest, account or property can change the relevance of a specific-purpose will. Request a review rather than editing the registered file.

Coordinate later estate documents

Tell any future adviser about this will before preparing another. Ensure that revocation or replacement instructions are deliberate.

DIFC will registration questions

Need to discuss your own circumstances?

What is the difference between a DIFC Full Will and a Property Will?

Their intended coverage and preparation requirements differ. A Property Will is a specific-purpose document, while a Full Will can address a broader set of instructions. Check the estate as a whole before selecting a form; our Dubai wills planning page explains which records to prepare.

Can registration be completed remotely?

The DIFC Courts describes electronic registration by video conference. Follow the current portal instructions for the testator, witnesses and signing devices.

Does the registry provide legal advice on my instructions?

The registry does not provide drafting or legal advice. Where a lawyer prepares the will within the agreed service, verify their entry on the DIFC Courts Register of Wills Draftsmen. Identify that professional’s advice and drafting responsibilities alongside the records and registration work.

What if I acquire more shares after registration?

The response depends on the will type and its wording. Have the new interest reviewed promptly, particularly where the document lists specific assets.

Can digital assets be included?

The DIFC Courts provides a Digital Assets Will option and information about digital assets within Full Wills. Confirm supported assets and current technical instructions directly.

Will the document automatically be enforced overseas?

Do not assume that. Any intended effect outside the UAE requires advice on the relevant jurisdiction and interaction with other estate arrangements.
